These terms govern your use of the HiQByte website. By using this site, you accept them. They're deliberately plain-spoken.
1. Who we are
HiQByte is a software development and consulting firm based in India, serving startups and mid-size product companies worldwide.
2. This website is informational
Content on this site — service descriptions, process explanations, scenarios and FAQ answers — is provided for general information. It is not professional advice for your specific situation, and it does not constitute an offer capable of acceptance.
3. Engagements are governed by separate agreements
Submitting the contact form, emailing us or speaking with us does not create a client relationship. Every engagement — including scope, deliverables, fees, timelines, intellectual property and any equity arrangement — is governed exclusively by a written agreement signed by both parties. In the event of any conflict between these terms and a signed engagement agreement, statement of work or NDA, the signed agreement prevails.
4. Confidentiality
We treat client information as confidential by default. Unless agreed otherwise in writing, both parties keep confidential — and do not disclose to any third party — any non-public business, technical, financial or project information shared in connection with an engagement, except where needed to perform the work, required by law, or with the other party's written consent. On request, we will sign a mutual Non-Disclosure Agreement before discovery or project work begins.
We do not publish, reference or showcase a client's name, logo, project details, architecture, results or case studies without that client's prior written permission. These obligations survive the completion or termination of an engagement.
5. Ownership & intellectual property
Unless a separate written agreement says otherwise, ownership of the deliverables we create for you — code, architecture, designs and documentation — transfers to you on full payment of the associated invoice or milestone. Ownership transfers only for work that has been paid for; unpaid work and materials remain ours until payment is received.
We retain ownership of our pre-existing intellectual property — methodologies, frameworks, templates, tools, know-how and reusable components developed independently of your engagement. Where these are included in a deliverable, we grant you a perpetual, worldwide, non-exclusive licence to use them as part of the delivered solution. Deliverables may include open-source or third-party components, which remain governed by their own licences.
The content, design and branding of this website belong to HiQByte. You may not copy, reproduce or use them commercially without our written permission.
6. Acceptable use
- Don't attempt to disrupt, probe or compromise this website.
- Don't use our contact form to send spam, solicitations or unlawful content.
- Don't scrape or republish site content at scale without permission.
7. Third-party links & services
This site may link to external sites and uses third-party services (described in our Privacy Policy). We aren't responsible for the content or practices of third parties.
8. Disclaimers
This website is provided "as is". We make reasonable efforts to keep information accurate and the site available, but we don't warrant that it is error-free, uninterrupted or always current.
9. Limitation of liability
To the maximum extent permitted by law, HiQByte is not liable for indirect, incidental or consequential damages arising from your use of this website. Nothing here limits liability that cannot be limited under applicable law.
10. Governing law
These terms are governed by the laws of India. Disputes relating to this website are subject to the jurisdiction of the courts of India.
11. Changes
We may update these terms from time to time. The effective date above reflects the latest version.
